Terms and Conditions
BeeFly Studios (Ross Birnie – Sole Trader)

These Terms and Conditions ("Terms") apply to all services provided by BeeFly Studios, operated by Ross Birnie as a sole trader ("we", "us", "our"), to the client ("you", "your"). By commissioning BeeFly Studios, you agree to these Terms in full.
1. Services Provided
BeeFly Studios provides professional video production services, including but not limited to filming, editing, post-production, and related media services, as agreed in writing before project commencement.
2. Quotations & Booking

All quotations are valid for 30 days from the date of issue.

A project is only considered booked upon written confirmation (e.g. signed agreement or confirmation via email) and, where required, a deposit.

We reserve the right to refuse work that conflicts with our values, capabilities, or availability.
3. Payment Terms

Invoices are issued upon project completion unless otherwise agreed.

Payment is due within 30 days of the invoice date, unless otherwise stated in writing.

If payment is not received in full by the due date — or within a maximum of 45 days from the invoice date — a late payment fee of 7% per week will be added to the outstanding balance until payment is received in full.

We reserve the right to suspend ongoing or future services until overdue payments are settled.
4. Cancellation & Postponement (by BeeFly Studios)

We reserve the right to cancel or postpone any project or booking with a minimum of 14 calendar days’ notice, inclusive of weekends and bank holidays.

If a deposit has been paid, it will be refunded in full unless cancellation is due to breach of contract or misconduct by the client.
5. Cancellation & Postponement (by Client)

Cancellations or date changes must be made in writing.

If the client cancels within 14 days of the shoot date, no fee is payable.

If cancellation occurs within 48 hours of the shoot, 50% of the agreed fee is payable.

Rescheduling is subject to availability and may incur additional costs depending on notice and resources already allocated.
6. Intellectual Property & Usage Rights

All raw footage remains the property of BeeFly Studios unless otherwise agreed.

Final edited content may be used by the client for the intended purpose as outlined in the agreement.

BeeFly Studios reserves the right to use excerpts of work for promotional purposes, unless otherwise agreed in writing.
7. Client Responsibilities

You agree to provide access, permissions, or materials required to complete the project on time.

You are responsible for securing all relevant third-party clearances (e.g. location permissions, talent releases) unless otherwise agreed.
8. Liability

BeeFly Studios will take all reasonable care during production, but we are not liable for events outside of our control (e.g. weather, technical failure, or client delay).

In no event shall BeeFly Studios be liable for indirect or consequential damages.
9. Amendments & Revisions
-
Minor edits (e.g. spelling, colour correction) are included in the quoted price.
-
Substantial revisions or re-edits outside the original scope may incur additional charges.
10. Governing Law
These Terms are governed by the laws of England, and any disputes shall be subject to the exclusive jurisdiction of the courts in that region.
